Myth 1: The H-1B Lottery is not random

Untrue. The H-1B lottery is totally random. As the process stands now, USCIS does not cherry-pick applications based on any criteria.

Myth 2: The H-1B Lottery selection depends on an employee's salary

This has been untrue in the past. This may be a deciding factor under the new administration for the FY2026 lottery selection in the year 2025.

Myth 3: The H-1B Lottery selection depends on the employee's location

Again, this has been untrue until the year 2024 lottery selection. This may be a deciding factor along with the location if the new administration passed new regulations that impact the FY2026 lottery selection in the year 2025.
