H-1B Eligibility

Position is a speciality occupation in science, technology, engineering, math, education etc.

Candidate has 4 years bachelor's degree or 12 years of work experience
​
Employee must be paid above the U.S. prevailing wage
​

THE PROCESS

Hiring someone on H-1B

First time H-1B applicants are subject to the annual cap of 85,000. This cap is for for-profit organizations. Higher education institutions and certain non-profits are cap exempt. Once on H-1B the employment can also be transferred by filing petition to transfer H-1B to an employer. 

HOW IT WORKS

Hire and retain foreign national employees on H-1B

3 years

Initial term

USCIS issues a three year working term when it first issues the H-1B. 

+ 3 years

Extension

One further three years extension is allowed for a maximum term of 6 years.

Employees who have completed certain Green Card application milestones can extend stay after 6 years.

Start the Green Card process

It's generally best-practice to start the green card process for the foreign national employee within the first 2 years of employment.

THE PROCESS

Hiring someone on H-1B1

Citizens of Singapore and Chile don't have to depend on their employers to file a petition or apply through the H-1B cap. They can apply directly for a visa at the U.S. embassy in their home counties. 

HOW IT WORKS

1 year

Initial term

USCIS issues a 12 months working term when it first issues the H-1B1. 

+ 1 year

Extension

Unlimited number of extensions (12 months each) are permitted.
