One of your H-1B employees returns from a two-week trip abroad. A CBP officer issued a new I-94 with a shorter expiration date. The employee didn't notice. HR didn't know to check. Months later, the employee has been working without valid authorization.

  • I-94 Truncation: An employee returns from international travel and a CBP officer has issued a new I-94 with a shorter expiration date. The employee doesn't flag it. HR doesn't know to check. We walk through what happened, what HR can do, and what to put in place so it doesn't happen again.

  • Status Changes Mid-Employment: An employee moves from OPT to H-1B, from H-1B to a Green Card, from CPT to OPT, or from H-1B to H-4 EAD. Does HR need to complete a new I-9? Reverify? Update the existing form? The answer is different depending on the change, and getting it wrong creates a compliance gap.

  • New I-9 vs. Reverification vs. Annotation: This is the question HR teams get wrong most often. We walk through exactly when each approach is required and what the rules say.
